Overview of Commercial Leasing Seminar
by Dolly Hoffman, Esq. and Jonathan Stein, Esq. |
Unlike its residential counterpart, Commercial Leasing is often fraught with highstakes issues, which, if not properly addressed can place a party at jeopardy after the ink dries. As the parties assume their roles pursuant to the lease, they may realize that they cannot exercise their rights in the manner they thought they would, or they may realize they have more obligations than those they had previously considered. By analogy, it is the difference between being “book smart” and being able to apply that knowledge.
The seasoned practitioner in Commercial Leasing understands that there are myriad issues which need to be addressed before he or she can assure a client, to the extent possible, of the maximum protection under the lease. For example, should a lease be recorded? What rights are at jeopardy if it’s not recorded? Are all of the provisions of the lease enforceable, or does the lease contain unenforceable penalties? What happens in the event of another 9-11 scenario? In what situations, if any, is the landlord required to mitigate his or her damages in the context of a commercial lease?
The seminar will address these and many other issues confronting both landlords and tenants in a commercial leasing transaction – common and uncommon. The lecturers, Dolly Hoffman and Jonathan Stein have a combined thirty-five years of experience in the area of commercial leasing, and will bring that experience to bear, addressing the common issues facing clients they have represented and why it is so important to go the extra mile when representing commercial landlords and tenants. Ms. Hoffman and Mr. Stein will address the practical concerns, legal issues, relevant statutory provisions and case law that might be applicable in a given situation facing a commercial leasing practitioner. The seminar is intended for practitioners at an intermediate level with at least some working knowledge of commercial leasing issues.
